Rules, breaches and penalties
Last updated 24 October 2026
Clayyard works only if everyone keeps their word. This page says, for each kind of user, what happens if someone breaks their agreement with Ekaade Services Private Limited, by mistake or on purpose, and how disputes are settled. It forms part of our terms and of every agreement that refers to it; the version that applies is the one shown here on the day the agreement was signed.
The amounts below are agreed compensation: a fair estimate, agreed in advance, of what a breach costs us or the other side. They are not fines.
Sellers and owners
Owners who list with Clayyard directly (Seller's exclusive listing agreement) or through an agent (Owner's consent).
| If someone… | What happens |
|---|---|
| Lists or advertises the property with another agent, website or app during the listing's term | ₹25,000 or 0.25% of the asking price, whichever is lower, for the checks, photos and marketing done. Clayyard may end the agreement. A sale made during the term still pays the full brokerage. |
| Sells to a buyer introduced through Clayyard without telling us, during the term or the 6 months after it | The seller's own 1% brokerage plus GST, plus the buyer's 1% that Clayyard could not collect because of it, plus interest and the cost of recovery. |
| Pays brokerage or a fee late | Interest at 18% a year from the due date until paid. |
| Gives false papers, or hides a loan, court case, dispute, tenancy or notice on the property | Listing removed. The owner pays Clayyard's actual costs (at least ₹10,000) and makes good any claim a buyer brings against Clayyard because of it. Clayyard may refuse to deal with the owner again. |
Agents and brokers
Clayyard member agents, under the agent's listing agreement and these terms.
| If someone… | What happens |
|---|---|
| Lists the same property on another website, app or portal during the term | First time: a written warning and the listing hidden for 15 days. Second time: ₹10,000 and the account suspended for 30 days. Third time: membership ended, with no refund. |
| Takes a buyer introduced through Clayyard off the platform, or does not report a deal (token, agreement or sale) within 3 days | The agent loses their share for that deal and pays Clayyard the share it lost. Membership ended with no refund, Founding agent badge removed, and Clayyard may report it to the RERA authority. Clayyard may refuse to deal with the agent again. |
| Charges the buyer or the seller any brokerage beyond what the agreement allows | The agent refunds it to the customer and loses their share of that deal. |
| Contacts another agent's registered buyer behind that agent's back | The share for that buyer goes to the agent who registered them. A second time: account suspended for 30 days. |
| Posts a fake or misleading listing, or false details about themselves | Listing removed, ₹5,000 for each such listing, and the account suspended. Serious or repeated cases: membership ended with no refund. |
| Pays brokerage or a fee late | Interest at 18% a year from the due date until paid. |
Buyers
Anyone who enquires about or visits a property through Clayyard (and signs the site-visit slip).
| If someone… | What happens |
|---|---|
| Buys a property introduced through Clayyard without paying the brokerage, directly or through a relative or company, during the term or the 6 months after it | The buyer's own 1% brokerage plus GST, interest at 18% a year, and the cost of recovery. Nothing more. |
| Pays brokerage or a fee late | Interest at 18% a year from the due date until paid. |
Builders
Builders under the builder listing and marketing agreement. These rules add to that agreement.
| If someone… | What happens |
|---|---|
| Shows wrong prices, units or availability, or keeps selling units shown on Clayyard as available without updating them | A written warning; if not corrected within 7 days, the project is hidden until it is. Repeated: the agreement may be ended. |
| Sells to a buyer introduced through Clayyard without paying the agreed fee | The agreed fee plus GST, plus interest and the cost of recovery. Clayyard may refuse to deal with the builder again. |
| Pays brokerage or a fee late | Interest at 18% a year from the due date until paid. |
Clayyard Exclusive members
Members of Clayyard Exclusive, the private collection.
| If someone… | What happens |
|---|---|
| Copies, screenshots, forwards or publishes Exclusive photos or details, or shares them with other agents or buyers | Membership ended at once, with no refund. The member makes good any loss it causes the owner or Clayyard. Every photo carries the member's name, and every listing opened is recorded. |
| Goes to the owner of an Exclusive property directly, to avoid Clayyard | Membership ended with no refund. If the property is bought, the buyer's 1% brokerage plus GST is due as on any sale, with interest and the cost of recovery. |
| Lets someone else use their membership | Membership ended with no refund. |
What Clayyard owes
Our own promises, so the rules are fair both ways.
| If Clayyard… | What happens |
|---|---|
| Pays an agent's share late (more than 7 days after receiving the brokerage) | Clayyard pays the agent interest at 18% a year for the delay. |
| Sends the owner the list of introduced buyers late (more than 7 days after the term ends) | The 6 months after the term are shortened by the number of days it was late. |
| Lets an owner's papers or ID be seen by anyone who should not see them | Clayyard makes good the actual loss, with no limit. |
How it is enforced
- A chance to put it right. Before any amount is charged, we write to you and give you 7 days to put the breach right. This does not apply to a hidden sale, false papers or fraud.
- A ceiling. Agreed compensation for one breach never exceeds 2% of the sale price, or 1% of the asking price if there is no sale. Brokerage itself, GST and interest are separate.
- Recovery. We send a GST tax invoice or a written demand; if it is not paid within 15 days, a legal notice; then the dispute steps below.
- Not dealing again. After a hidden sale, false papers, fraud or a serious breach, Ekaade Services Private Limited may refuse to deal with that person or firm again. We keep a private record of this, seen only by our directors and authorised staff and never published, and the person is told and may object. See our privacy policy.
Disputes and jurisdiction
- The parties first try to settle any dispute by talking, for 15 days.
- If that fails, the dispute goes to a sole arbitrator at Jammu, under the Arbitration and Conciliation Act, 1996, in English. The arbitrator's award is final and binding.
- The courts at Jammu alone have jurisdiction for urgent interim orders and to enforce an award.
- Every agreement with Ekaade Services Private Limited is governed by the laws of India.
- Nothing here takes away a consumer's rights under the Consumer Protection Act, 2019, or anyone's right to complain to the RERA authority.
